Terms & Conditions

1.1 All creative media services performed by AppleBox are governed by these Terms of
Engagement.

2.1 All prices exclude GST unless otherwise stated. AppleBox is GST-registered, and invoices will include 15% GST as required by New Zealand law.

2.2 Quotes are valid for 14 days and may be subject to change after this period.

2.3 Additional hourly, half-day or daily charges may apply if the agreed timeframe is exceeded, unless due to an error on AppleBox's part.

3.1 Payment is to be made via credit card or bank transfer through AppleBox’s accounting
provider (Hnry). A 50% deposit is required upon acceptance of the quote, no later than 72 hours before work commences. Deliverables are released upon full payment.

3.2 AppleBox reserves the right to request full payment upfront for any project, regardless of prior arrangements. For large or multi-stage projects, progress payments may be required.

4.1 A $200 postponement fee applies to bookings postponed within 48 hours of the shoot date.

4.2 A cancellation fee of 20% of the total quote applies to cancellations made within 14 days of the shoot date.

4.3 The Client is responsible for all non-refundable third-party costs incurred, including but not limited to actor fees, crew time, venue hire, pre-production work, and equipment hire.

4.4 In cases of force majeure (including but not limited to natural disasters, illness, or government restrictions), both parties will negotiate in good faith regarding fair rescheduling or cancellation fees.

5.1 Travel, accommodation, parking, per diem, and administrative disbursements will appear as separate line items in the quote. These are estimated and subject to change.

5.2 An "Out of Christchurch" fee will apply when travel and/or overnight stays are required. Flights and accommodation costs are to be covered by the Client unless otherwise agreed.

5.3 Any additional or varied charges will be communicated and agreed upon in writing before work proceeds.

6.1 In the event of illness or emergency, AppleBox may provide a substitute videographer, subject to the Client’s approval.

6.2 If a suitable replacement is unavailable or declined by the Client, AppleBox's liability is limited to a refund of any payments made.

7.1 The Client agrees to promptly communicate any changes to shoot times, dates, or locations.

7.2 Safety is a priority. AppleBox reserves the right to cancel, pause, or redirect filming if
conditions are unsafe or disruptive.

7.3 AppleBox uses professional, well-maintained equipment but is not liable for unforeseen
technical issues outside of its control, including but not limited to SD card corruption, hard drive failure, or data loss. In the case of total failure, liability is limited to a refund of fees paid.

7.4 While every effort will be made to capture ideal colour and lighting, environmental conditions (e.g. mixed lighting, shadows) may affect results.

7.5 Only AppleBox personnel are permitted to handle production equipment unless otherwise agreed. The Client is liable for damage resulting from unauthorised handling.

8.1 AppleBox will consider the Client’s style and brief but retains creative discretion over edits and presentation.

8.2 The Client acknowledges they are satisfied with AppleBox's work quality and creative style based on prior examples.

8.3 If the Client delays post-production feedback or material delivery beyond 30 days, AppleBox reserves the right to cancel the project or charge for additional storage.

9.1 A draft will be provided for one round of review. Feedback must be submitted in writing within 7 days unless otherwise agreed.

9.2 Further changes or review rounds may incur additional costs unless previously included in the quote.

9.3 If no feedback is received within 7 days of delivery, the deliverables are deemed approved and final.

10.1 AppleBox may charge interest at 5% per 30 days on overdue payments and may refer
unpaid invoices to a debt collection agency. The Client will be liable for any recovery costs, including legal fees.

11.1 All creative concepts and project information must remain confidential and may only be shared with relevant AppleBox crew, collaborators, or stakeholders.

12.1 AppleBox retains ownership of all raw footage, project files, and unedited materials.

12.2 The Client receives a non-exclusive, non-transferable license to use the final deliverables for their own promotional, internal, or agreed-upon commercial purposes.

12.3 The Client may not repurpose deliverables for third-party use without AppleBox's written consent.

12.4 Generic B-roll captured during filming (e.g. scenery, non-branded moments) may be reused by AppleBox as stock footage.

12.5 AppleBox retains the right to use project materials in its own promotional content (showreels, social media, website, etc.), unless otherwise agreed in writing.

13.1 AppleBox stores raw footage and project files for 6 months from final delivery.

13.2 After 6 months, materials may be deleted at AppleBox's discretion unless the Client arranges an extended archive (fees apply).

13.3 Storage does not imply ownership or access. Raw footage is not supplied to the client unless specifically agreed to in writing and may incur a fee.

13.4 All footage, including raw and project files, remains the intellectual property of AppleBox unless explicitly transferred in writing. Usage rights are limited to the final deliverables provided under this agreement.

14.1 AppleBox will provide licensed music where required. If the Client supplies music, they are solely responsible for obtaining appropriate usage rights and indemnify AppleBox from any resulting claims.

15.1 AppleBox may credit the Client and display finished work in promotional materials unless the Client requests otherwise in writing.

15.2 The Client agrees to provide a copy of the final work for portfolio use if not otherwise shared.

• AppleBox: Refers to AppleBox as the production company.

• The Client: The individual or organisation engaging AppleBox's services.

• Deliverables: The final edited video or media content delivered upon completion of the
project.

• Raw Footage: Unedited video and audio files captured during production.

• Project Files: All working files, graphics, and assets used during post-production.
